Terms of Service
1. About Khinkali.com
Khinkali.com, together with khachapuri.com, georgianrestaurants.com and georgianfood.com (the "Site"), is a directory and ordering service for Georgian food, operated by Ujarmeli LLC, a Wisconsin limited liability company ("we", "us"). By using the Site you agree to these Terms. Businesses that join as partners also agree to the Merchant Services Agreement.
2. Orders
- When you send an order request, we forward it to a nearby participating restaurant or shop (the "Seller"). A contract for the food or goods is formed only between you and the Seller when the Seller accepts and confirms your order. We are not the seller, do not prepare or deliver food, and are not responsible for the Seller's food, prices, delivery or service.
- If the first Seller cannot take your order, we may forward it to another nearby Seller. We do not guarantee that a Seller will accept your order.
- Prices, availability, delivery fees and delivery times are set by the Seller. Ask the Seller about ingredients and allergens before ordering.
- Alcohol is sold only by Sellers licensed to do so and only to adults of legal drinking age, who may be asked for ID on delivery.
3. Payments
You pay the Seller, either directly (cash or the Seller's card terminal) or online through a secure payment link processed by Stripe on the Seller's behalf. Card details are handled by Stripe and are never stored by Khinkali.com. Refunds and complaints about an order are handled by the Seller; contact us at orders@khinkali.com if you cannot resolve an issue.
4. Directory information
We compile listings from public sources and from businesses. Listings may be incomplete or out of date. Businesses can ask to correct or remove their listing at partners@khinkali.com.
5. Acceptable use
Do not send false, abusive or automated order requests, try to disrupt the Site, or copy the directory in bulk. We may block requests that misuse the Site.
6. Privacy notice
- What we collect. For order requests: your name, phone, email (optional), delivery address, order details and IP address. For partner applications: business, contact and listing details and the acceptance record of the Merchant Services Agreement.
- How we use it. To forward your order to Sellers and send you confirmations, to run and protect the Site, to bill partners, and to comply with the law. We do not sell personal information and do not use it for advertising.
- Who receives it. The Seller(s) your order is forwarded to; our service providers for hosting (Cloudflare), email delivery (Resend) and payments (Stripe); and authorities where required by law.
- How long we keep it. Order records are kept for up to 3 years for accounting and dispute purposes, then deleted.
- Your rights. You can ask to access, correct or delete your personal information, and California residents have the rights given by the CCPA, by writing to orders@khinkali.com.
7. Disclaimers and liability
The Site is provided "as is". To the fullest extent permitted by law, Ujarmeli LLC is not liable for any food, goods, delivery or conduct of Sellers, or for indirect or consequential damages. Our total liability to you for any claim about the Site is limited to $100.
8. General
These Terms are governed by the laws of the State of Wisconsin; the state and federal courts located in Wisconsin have exclusive jurisdiction, except where consumer law gives you the right to sue in your home courts. We may update these Terms by posting a new version on this page.
